1. Acceptance of Terms

Welcome to Haven. These Terms of Service ("Terms") constitute a legally binding agreement between you and Limit Waste Sp. z o.o. ("Company," "we," "us," or "our") governing your access to and use of the Haven mobile application ("App") and all related services.

By downloading, installing, accessing, or using Haven, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the App.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms in the App or by sending you a notification. Your continued use of Haven after such modifications constitutes your acceptance of the revised Terms.

3. Eligibility and Age Requirements

Haven is intended for users who are at least 16 years of age. By using the App, you represent and warrant that:

  • You are at least 16 years old
  • You have the legal capacity to enter into a binding agreement
  • You are not prohibited from using the App under applicable laws
  • You will comply with these Terms and all applicable local, national, and international laws

Important: If you are under 16 years of age, you are not permitted to use Haven. We do not knowingly collect or maintain information from individuals under 16.

4. Account Registration

To access certain features of Haven, you must create an account. When registering, you agree to:

  • Provide accurate information: You must provide a valid email address and accurate account information
  • Maintain security: You are responsible for maintaining the confidentiality of your password and account credentials
  • Notify us of breaches: You must immediately notify us of any unauthorized access to or use of your account
  • Accept responsibility: You are responsible for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, misleading, or fraudulent, or if you violate these Terms.

5. Description of Services

Haven is a spiritual wellness mobile application that provides:

  • Daily Bible verses - Personalized scripture delivered daily based on your preferences
  • AI-powered spiritual reflections - Interactive conversations for spiritual journaling and reflection
  • Spiritual journeys - Curated multi-day programs for guided spiritual growth
  • Verse collections - Tools to save, organize, and revisit meaningful scriptures
  • Gentle Rhythm - Streak tracking and engagement metrics to encourage consistent spiritual practice
  • Multi-language support - Content available in multiple languages and Bible translations

6. Subscription Plans and Pricing

Haven offers both free and premium subscription options. This section explains your subscription options, billing terms, and your rights regarding subscriptions.

6.1 Free Features

The following features are available to all users at no cost:

  • Daily Bible verses
  • Basic verse collections (limited number)
  • Selected introductory spiritual journeys
  • Basic app functionality

6.2 Haven Premium Features

A Haven Premium subscription unlocks additional features:

  • Unlimited AI Reflections - Unlimited conversations with our AI spiritual companion
  • Full journey library - Access to all spiritual journeys
  • Unlimited collections - Create unlimited verse collections
  • Priority support - Faster response times for support inquiries

6.3 Subscription Plans

Haven Premium is available in three subscription tiers:

  • Monthly Subscription: Billed monthly, provides maximum flexibility with the ability to cancel anytime
  • Quarterly Subscription (3 months): Billed every three months at a reduced per-month rate compared to monthly
  • Annual Subscription: Billed once per year at the lowest per-month rate, offering the best value

Current pricing is displayed in the App before purchase and may vary by region and currency. Prices are subject to change, and any price changes will be communicated to you in advance.

6.4 Free Trial

7-Day Free Trial: New subscribers may be eligible for a 7-day free trial of Haven Premium. During the trial period, you will have full access to all Premium features.

Important information about the free trial:

  • The free trial is available once per user and is tied to your Apple ID or Google account
  • If you have previously redeemed a free trial, you may not be eligible for another
  • Your subscription will automatically convert to a paid subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends
  • You can cancel the trial at any time through your device's subscription settings without being charged
  • If you cancel during the trial period, you will retain access to Premium features until the trial ends

7. Payment and Billing

7.1 Payment Processing

All payments for Haven Premium subscriptions are processed through the platform from which you downloaded the App:

  • iOS users: Payments are processed through the Apple App Store
  • Android users: Payments are processed through the Google Play Store

We use RevenueCat as our subscription management platform to synchronize your subscription status across devices. We do not directly collect, store, or process your payment card details. All payment information is handled securely by Apple or Google.

7.2 Automatic Renewal

Auto-Renewal Notice: All Haven Premium subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.

Key billing information:

  • Your subscription will automatically renew for the same duration (monthly, quarterly, or annually) at the current subscription price
  • Payment will be charged to your Apple ID or Google account at confirmation of purchase
  • Renewal charges are processed within 24 hours prior to the end of the current period
  • You can view your next renewal date in your device's subscription settings

7.3 Price Changes

We may change subscription prices from time to time. If we change the price of your subscription:

  • We will notify you in advance through the App or via email
  • Price changes will take effect at the start of your next billing period following the notice
  • If you do not agree to the price change, you may cancel your subscription before the change takes effect
  • Your continued use of Haven Premium after a price change constitutes acceptance of the new price

8. Cancellation and Refunds

8.1 How to Cancel Your Subscription

You may cancel your Haven Premium subscription at any time. Cancellation must be done through your device's subscription settings, not within the Haven app.

To cancel on iOS (Apple):

  1. Open the Settings app on your device
  2. Tap your name at the top, then tap "Subscriptions"
  3. Select your Haven subscription
  4. Tap "Cancel Subscription" and confirm

To cancel on Android (Google Play):

  1. Open the Google Play Store app
  2. Tap Menu, then "Subscriptions"
  3. Select your Haven subscription
  4. Tap "Cancel Subscription" and follow the instructions

8.2 Effect of Cancellation

When you cancel your subscription:

  • Access continues: You will retain access to Haven Premium features until the end of your current billing period
  • No future charges: Your subscription will not renew, and you will not be charged again
  • After expiration: When your subscription period ends, your account will revert to the free tier
  • Data retention: Your account data, including collections and progress, will be preserved and accessible if you resubscribe

8.3 Refund Policy

Important: Refunds for in-app purchases and subscriptions are handled by Apple or Google, not by us directly. We do not have the ability to process refunds for purchases made through the App Store or Google Play.

Refund terms:

  • No prorated refunds: Cancellation does not entitle you to a refund for any portion of the current billing period
  • Apple App Store refunds: To request a refund for iOS purchases, visit reportaproblem.apple.com
  • Google Play refunds: To request a refund for Android purchases, visit the Google Play Help Center
  • Refund decisions are made at the sole discretion of Apple or Google in accordance with their respective policies

8.4 Free Trial Cancellation

If you are on a free trial and wish to avoid being charged:

  • You must cancel at least 24 hours before the trial period ends
  • If you cancel within this timeframe, you will not be charged
  • If you fail to cancel before the trial ends, your payment method will be charged for the subscription

9. User Conduct

By using Haven, you agree to use the App responsibly and in accordance with these guidelines. You agree NOT to:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the App for any unlawful, harmful, or fraudulent purpose
  • Attempt to gain unauthorized access to the App, other users' accounts, or our systems
  • Interfere with or disrupt the integrity or performance of the App or its servers
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use automated systems, bots, or scripts to access or interact with the App
  • Share your account credentials with others or allow others to access your account
  • Upload, transmit, or distribute any viruses, malware, or other harmful code
  • Use the AI Reflections feature to generate inappropriate, harmful, or offensive content
  • Misrepresent your identity or affiliation with any person or entity
  • Circumvent, disable, or interfere with security features of the App

We reserve the right to investigate and take appropriate legal action against anyone who violates these provisions, including terminating their account and reporting them to law enforcement authorities.

10. Intellectual Property

10.1 Our Content

The Haven App, including its design, features, functionality, graphics, user interface, and all related documentation, is owned by Limit Waste Sp. z o.o. and is protected by intellectual property laws. This includes:

  • The Haven name, logo, and branding
  • App design, layout, and user interface elements
  • Original content created by us, including spiritual journeys
  • Software code and algorithms
  • AI systems and responses generated by our platform

10.2 Bible Content

Haven provides access to Bible content from various translations. Bible text is used under license or from public domain sources. The specific translations available in the App are subject to their respective copyright holders' terms and conditions.

10.3 Your Content

You retain ownership of any content you create within Haven, such as personal notes, collection names, and messages within AI Reflections. By using the App, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the services to you.

10.4 Restrictions

You may not:

  • Copy, modify, or distribute our content without written permission
  • Use our trademarks, logos, or branding without authorization
  • Remove any copyright, trademark, or other proprietary notices
  • Create derivative works based on the App or its content

11. AI Reflections Disclaimer

Important Notice: The AI Reflections feature is designed to provide spiritual reflection prompts and companionship. It is NOT a substitute for professional counseling, therapy, mental health treatment, or pastoral care from a qualified religious leader.

By using the AI Reflections feature, you understand and agree that:

  • Not professional advice: AI-generated responses are for spiritual reflection purposes only and do not constitute professional counseling, psychological, medical, or religious advice
  • AI limitations: The AI may produce responses that are inaccurate, inappropriate, or inconsistent with specific theological traditions
  • No therapeutic relationship: Using AI Reflections does not create a counselor-client, therapist-patient, or pastor-parishioner relationship
  • Seek professional help: If you are experiencing mental health issues, emotional distress, or spiritual crisis, please seek help from qualified professionals
  • Emergency situations: The App is not designed for use in emergencies. If you are in crisis, contact emergency services or a crisis helpline in your area

12. Content Disclaimer

Haven is designed to support your personal spiritual journey and provide tools for reflection and growth. However:

  • General spiritual content: Our content is intended for general spiritual enrichment and may not align with every user's specific religious tradition or beliefs
  • Not authoritative interpretation: The App does not claim to provide authoritative biblical interpretation or represent any specific denomination or religious organization
  • Personal discernment: We encourage users to exercise personal discernment and consult with trusted religious leaders regarding matters of faith and doctrine
  • No guarantees: We do not guarantee any specific spiritual outcomes or results from using the App

13. Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using Haven, you acknowledge that you have read and understood our Privacy Policy and consent to the collection and use of your information as described therein.

14. Account Termination

14.1 Termination by You

You may delete your Haven account at any time through the App settings or by contacting us at contact@try-haven.app. Upon account deletion:

  • Your account and associated data will be permanently deleted
  • Any active subscription will remain in effect until the end of the current billing period (you must separately cancel through Apple/Google)
  • This action cannot be undone

14.2 Termination by Us

We may suspend or terminate your account and access to Haven at our discretion, with or without notice, if:

  • You breach these Terms of Service
  • We reasonably believe your conduct may harm us, other users, or third parties
  • We are required to do so by law
  • We discontinue the App or any part of its services

14.3 Effect of Termination

Upon termination for any reason:

  • Your license to use the App is immediately revoked
  • Provisions that by their nature should survive termination will remain in effect, including intellectual property rights, disclaimers, limitations of liability, and dispute resolution provisions

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HAVEN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We specifically disclaim all implied warranties, including but not limited to:

  • Merchantability: We do not warrant that the App will meet your requirements or expectations
  • Fitness for a particular purpose: We do not warrant that the App is suitable for any specific purpose
  • Non-infringement: We do not warrant that the App does not infringe any third-party rights
  • Availability: We do not guarantee that the App will be available at all times or without interruption
  • Accuracy: We do not warrant that all content, including AI-generated responses, will be accurate or error-free
  • Security: While we implement reasonable security measures, we cannot guarantee absolute security of your data

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIMIT WASTE SP. Z O.O. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This limitation applies to damages arising from:

  • Use or inability to use the App
  • Unauthorized access to or alteration of your data
  • Statements or conduct of any third party in connection with the App
  • Any other matter relating to the App

Maximum liability: In no event shall our total liability to you exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty euros (EUR 50), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above limitations may not apply, and you may have additional rights.

17. Indemnification

You agree to indemnify, defend, and hold harmless Limit Waste Sp. z o.o. and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of any third party
  • Any content you submit, post, or transmit through the App

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

For EU consumers: If you are a consumer residing in the European Union, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

Consumer protection: These Terms do not limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence.

19. Dispute Resolution

19.1 Informal Resolution

Before filing any formal legal claim, you agree to contact us at contact@try-haven.app to attempt to resolve any dispute informally. We will make good faith efforts to resolve any issue through direct communication.

19.2 Jurisdiction

If informal resolution is unsuccessful, any disputes arising from these Terms or your use of Haven shall be subject to the exclusive jurisdiction of the courts located in Kielce, Poland, unless otherwise required by applicable consumer protection laws.

19.3 EU Online Dispute Resolution

If you are a consumer in the European Union, you may also use the European Commission's Online Dispute Resolution (ODR) platform available at https://ec.europa.eu/consumers/odr.

20. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the "Last Updated" date at the top of these Terms
  • For material changes, we will provide notice through the App, via email, or by other appropriate means
  • Changes will become effective upon posting, unless otherwise specified
  • Your continued use of Haven after changes are posted constitutes acceptance of the modified Terms

We encourage you to review these Terms periodically. If you disagree with any changes, you should stop using the App and may request account deletion.

21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

22. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us in the App, constitute the entire agreement between you and Limit Waste Sp. z o.o. regarding your use of Haven. These Terms supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.

23. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

24. Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
